The position will be responsible for providing in-house legal support within the General Counsel’s Office to the ADHS Executive Team and acts as a liaison between the Agency and the Attorney General's office and outside counsel. The position will be responsible for responding to management and staff inquiries, conducting assigned legal research, and providing advice to assist in resolving issues affecting the Agency. The position is accountable for: the oversight of administrative hearing cases; the issuance of appealable agency actions and Director decisions; the tracking and responding to record requests and the resolution of attendant confidentiality/privacy issues; and the acceptance of service of subpoenas, lawsuits, complaints, and claims and the coordination of responses. The Administrative Counsel (Grade 26) is responsible for reviewing and signing on behalf of the Director: appealable agency actions; notices of hearings; notices of informal settlement conferences; Director's Decisions, and Final Orders related to administrative hearings cases.
Responsibilities include:

• Responsible for tracking, reviewing and responding to subpoenas and court orders and the resolution of attendant confidentiality/privacy issues; and the acceptance of service of subpoenas, lawsuits, complaints, and claims and the coordination of responses.
• Other duties as assigned as related to the position.
Knowledge of:
• Federal and State laws governing confidentiality of records, including HIPAA, FERPA, and other Federal privacy regulations, and impact on programs administered by ADHS.
• State statutes and Department processes related to public record requests.

• Arizona Administrative Procedure Act; administrative hearing process; litigation process; and principles and practices of administration Comprehensive Knowledge of:

• Administrative hearing process, including standard of proof, burden of proof, application of the law to the facts of a particular administrative hearing case, and fair hearing requirements.

• Two years' experience involving high level analysis of programs or processes and legal documents preferred.
• Juris Doctorate degree from an ABA accredited law school. Licensed to practice law in the State of Arizona and membership in good standing.
