Job Summary:

Under general direction, this classification independently performs highly analytical tasks in response to complex claims and lawsuits against the state, including its agencies, boards, commissions, universities and county court systems.

This position will investigate, evaluate, subrogate, settle and/or monitor the defense of claims and lawsuits made against the state under the authority of ARS §41-621 and other applicable authority.

This position ensures that all work completed complies with Arizona Revised Statutes, Arizona Administrative Codes, court procedure, intergovernmental agreements, third party contracts and agency vendor contracts and guidelines, policies and procedures.

Job Duties:

• Investigate coverage, liability and damage exposure in accordance with Arizona Revised Statutes, common law, AZ Administrative Code and other applicable authority. This will include site visits and statewide travel on occasion

• Collaborate with agency representatives, loss prevention consultants, legal counsel, outside consultants/experts & large loss support specialist to identify potential exposures, develop effective mitigation plans, monitor implemented action plans, conduct trending analysis, cost benefit analysis, contract review, policy and procedure review

• Conduct, participate in or monitor interviews, litigation meetings, depositions, mediation, arbitrations, pretrial conferences, trial, JLBC hearings, agency meetings, etc

• Manage claim file in accordance with statute, administrative code, policy/procedure which include properly coding & updating information in the Risk Management Information System: claim coding, document indexing/imaging, set reserves, maintaining diary, log notes, confirming contacts/communications, coverage determination, investigations, evaluations, subrogation potential, completed reports, defense & settlement strategies, negotiation efforts, plan of action, legal proceedings, mediation & trial results, final resolution, etc

• Develop and conduct training, perform audits and complete special projects; participate in lean/kaizen teams; write business standardizations

• Prepare reports such as status reports, settlement authorizations, trial recommendations, etc

• Other duties as assigned as related to the position

Knowledge, Skills & Abilities (KSAs):

Knowledge:

• Thorough knowledge in adjusting highway design claims, medical malpractice claims, slip and fall claims, employment claims, auto liability claims, bodily injury and personal injury claims, DES/CPS care-custody & control claims, and other general liability claims

• Considerable knowledge of economic and accounting principles, financial markets, banking, and the analysis of and reporting of financial data

• Extensive knowledge of the operations of state government, policies and procedures, as well as a clear understanding of other public entity relationships and legal responsibilities that run concurrent with State obligations

• Extensive knowledge of the Arizona Revised Statutes, Arizona Administrative Code, and Executive orders

• Extensive knowledge of State and Federal court procedures, precedents, case law and contract law

• Thorough knowledge of property and liability laws and adjusting and subrogation principles

• Knowledge in paperless systems, data validation, and conditional formatting

• Thorough knowledge of investigation techniques and evaluation methods

• Knowledge of insurance industry, AMS and lean terminology

• Knowledge of metrics and how it applies to position

• Thorough knowledge in preserving evidence

Selective Preference(s):

• Bachelor's Degree or 8-10 years of related professional experience

Pre-Employment Requirements:

• Employees who drive on state business are subject to driver’s license record checks, must maintain acceptable driving records and must complete any required driver training (see Arizona Administrative Code R2-10-207.12.)

• Requires possession of and ability to retain a current, valid state-issued driver’s license appropriate to the assignment
